This seminar will address the recently enacted “Extreme Risk” gun safety law which allows law enforcement and family members to apply for an order removing an individual’s right to possess or own a firearm. Topics will include how a temporary order (TRPO) is obtained and the process, legal standard and issues at the hearing for a final order.
Hon. Margaret M. Foti, P.J.Cr. began her judicial career as a Superior Court Judge in July 2009 in the Family Part in Hudson County, hearing children in court cases. In August 2011, she was reassigned to the Family Part in Bergen County where she has handled all case types, including post-judgment FM motions, but primarily children in court matters. In March 2015, she moved to the Criminal Part in Bergen County and was named presiding judge in March 2017. She is licensed to practice law in New York and New Jersey. Prior to becoming a judge, she worked as an attorney with the Law Firms of LeBoeuf, Lamb, Greene & MacRae in Newark, and Winne Banta in Hackensack. She also served as a Deputy Attorney General in both the divisions of law and criminal justice, as chief counsel to Governor Christine Todd Whitman and as a Special Agent with the Federal Bureau of Investigation.
Tom Dominic Osadnik, Esq. has been an Assistant Prosecutor since December 18, 2017. Prior to joining the BCPO, Tom was an Assistant Prosecutor in Passaic County for five years. Tom is a 2008 graduate of American University where he earned his BA in Political Science. Tom graduated Pace University School of Law in 2011 with his Juris Doctor. After graduation, Tom clerked for the Honorable Robert C. Wilson in the Superior Court of New Jersey, Bergen Vicinage. Tom is presently assigned to the Civil Section where he handles firearms revocations and appeals of denials of applications for gun permits. He also is the legal liaison for all municipal departments regarding evidence room management and firearms. Tom frequently lectures on topics such as the Extreme Risk Protective Order, Duty to Warn, and Evidence Room Management.
Laura C. Sutnick, Esq. is a partner at the law firm of Sutnick & Sutnick LLC and is certified by the Supreme Court of New Jersey as a Criminal Law Trial Attorney. She is an officer of the Bergen County Bar Association and is the co-chair of the BCBA Municipal Court and Criminal Law Practice Committees. Ms. Sutnick began her career as a senior trial attorney at the Kings County District Attorney’s Office in Brooklyn, New York. Her practice is devoted to criminal defense in New Jersey and New York.
