SUPREME COURT OF NEW JERSEY
This matter having come before the Court on the request for relief filed jointly by the New Jersey Office of the Public Defender and the American Civil Liberties Union of New Jersey, seeking the Court’s consideration of a proposed Order to Show Cause designed to address the release of certain individuals serving sentences in state prisons and juvenile facilities; and
The parties having filed briefs consistent with the Court’s order dated May 11,2020; and
The Rutgers Criminal and Youth Justice Clinic having filed a motion for leave to participate as amicus curiae, pursuant to Rule 1: 13-9, and the parties having provided their positions on the motion for leave to appear and their responses to the merits of the proposed amicus brief;
It is ORDERED that the motion for leave to appear as amicus curiae is granted, including participation at oral argument; and
It is further ORDERED that the parties shall appear for oral argument on the Order to Show Cause on Wednesday, May 27, 2020 at 10:00 a.m. Oral argument shall proceed virtually. In addition, by 4:30 p.m. on Tuesday, May 26, 2020, the Attorney General shall provide the Court with updated figures with respect to how many prisoners have been processed under Executive Order No. 124 (Apr. 10, 2020), including how many have been approved and released. No further briefing shall be permitted absent leave of Court.
